1. Who you are contracting with

Canvas Curator ("the Service") is operated by Hanva, LLC ("Hanva", "we", "us"). By accessing or continuing to use the Service you agree to these Terms & Conditions. If you are using the Service on behalf of an organisation, you confirm you have authority to bind it; otherwise you confirm you are of legal age to enter this agreement.

2. The service

Canvas Curator uses generative AI to identify paintings from a photo you upload or capture, or from a title you type, and returns details such as the likely artist, year, movement, palette, technique and historical context. Each identification is purchased individually.

3. Acceptable use

You must not misuse the Service. In particular, you must not:

  • use it for any unlawful purpose, fraud, or spam;
  • upload content you do not have the rights to submit;
  • infringe the intellectual property or privacy rights of others;
  • upload illegal content, create deepfakes, hate speech, harassment or malware, or attempt to jailbreak, prompt-inject or otherwise circumvent our safety controls;
  • interfere with the security of the Service, including probing, scraping, or automated bulk access.

4. AI outputs and accuracy

Identifications are generated by an AI model and may be incomplete, outdated or wrong. You are responsible for the images and prompts you submit, for verifying results before relying on them, and for how you use the outputs. Results are provided for general and educational purposes only and are not an appraisal, authentication, provenance certification, or professional advice for insurance, sale, or legal purposes.

You retain rights in the images you submit and grant us a limited licence to process them solely to produce your identification result. You receive the identification text we return for your own use. If you believe content processed through the Service infringes your rights, contact us and we will review and, where appropriate, remove it; repeat infringers lose access.

5. Content moderation

We may filter, refuse, restrict or remove inputs and outputs, and suspend accounts, where we reasonably believe these Terms have been broken or where required to keep the Service safe and lawful.

6. Intellectual property

Hanva, LLC retains all rights in the Service, including its software, interface, branding and documentation. You receive a limited, non-exclusive, non-transferable right to use the Service. You may not reverse engineer it, resell or redistribute it, or circumvent its technical limits.

7. Payment, billing and refunds

Canvas Curator is sold by Hanva, LLC on a pay-per-use basis at $1.99 per identification. Card payments, tax calculation and invoicing are processed securely by Stripe; Hanva, LLC never stores your card details.

In the United States the $1.99 price includes tax. Elsewhere, applicable VAT, GST or sales tax is calculated and added at checkout before you pay. See our Refund Policy for how to request a refund.

8. Service level and warranties

We do not guarantee that the Service will be uninterrupted, error-free, or that any particular result will be produced. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the 12 months before the claim. We exclude liability for indirect, consequential or special damages, including lost profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

You will indemnify us against claims arising from content you submit, your unlawful use of the Service, or your breach of these Terms.

10. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your right to use the Service ends; identification results already delivered to you remain yours.

11. General

These Terms are governed by the laws of the State of Delaware, United States, and disputes will be heard in the courts of that jurisdiction. You may not assign this agreement without our consent; we may assign it in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control.
